Description of services
The Provider carries out in particular the activities below, as stated in its registration and activity declarations. The detail of deliverables, terms and commitments for each engagement is set out in the quote or order form accepted by the Client.
Main activity
Professional training, teaching and educational services in all forms and on all media, including the web, digital and technology, for any audience. This also includes designing, building, maintaining and operating digital solutions (websites, web applications and platforms), digital consulting, project management, and creating, publishing and marketing digital content and services.
Other activities
- Digital services: design, implementation, management and maintenance of websites and digital solutions.
- Consulting, technical assistance and web project support for professionals and consumers.
- Production, management and distribution of digital content; digital communication, web writing, community management and online visibility (SEO).
Quotes, orders and contract evidence
Commercial proposals (quotes) specify the nature of the services, prices, indicative timelines and any special conditions. The order is binding after written acceptance of the quote (signature, order form, agreement email or any equivalent means leaving a written record), subject to withdrawal information applicable to consumers.
For training services or funding schemes (OPCO, personal training account, etc.), registration numbers, certifications or accreditations (for example Qualiopi when held) and eligibility terms, when they exist, are stated on the relevant quotes and contract documents.
Prices and payment
Prices are in euros on the accepted quote. Invoices mention VAT not applicable, article 293 B of the French Tax Code (micro-enterprise scheme).
Payment terms (bank transfer, deposit, schedule) are those on the accepted quote. Unless otherwise agreed on the quote, the payment period for business customers is thirty (30) days from performance of the service, in accordance with article L.441-10, I of the French Commercial Code.
For business customers, late payment triggers late-payment interest at the rate applied by the European Central Bank to its most recent refinancing operation, increased by 10 percentage points, which may not be less than three times the legal interest rate, plus a fixed recovery indemnity of 40 euros for collection costs, in accordance with article L.441-10 of the French Commercial Code and article D.441-5 of the French Commercial Code.
Performance timelines
Stated timelines are targets or indicative deadlines unless a firm deadline is expressly agreed in the quote. The Provider is bound by an obligation of means when performing intellectual and technical services.
Any delay attributable to the Client (e.g. missing approval, content or access not provided) extends the schedule. Cases of force majeure under French law suspend or excuse performance as provided by law.
Right of withdrawal
When the customer is a consumer and the contract is concluded at a distance, the withdrawal period is fourteen (14) days from the day the contract is concluded (services) or from the day the goods are received, unless a legal exception applies (including full performance of a service before the end of the period with the consumer’s express prior agreement and express waiver of the right of withdrawal; article L.221-28 of the French Consumer Code).
If the consumer asked for performance to begin during the withdrawal period, article L.221-25 of the French Consumer Code applies: they pay an amount proportional to the service provided up to withdrawal.
For yunt Academy digital content supplied without a tangible medium, the right of withdrawal does not apply once performance has begun, subject to the consumer’s express prior agreement and express waiver, in accordance with article L.221-28, 13° of the French Consumer Code.
To withdraw, send an unambiguous statement using the withdrawal form or by email to contact@yunt.fr, or by post to 6 rue d'Armaillé, 75017 Paris, France.
If withdrawal is valid, yunt refunds all sums received within fourteen (14) days of notification, using the same payment method unless you expressly agree otherwise, and at no extra charge.
Business customers acting in the course of their trade do not generally benefit from consumer withdrawal rights; cancellation or termination terms are those in the quote, these terms of sale and ordinary contract law.
Liability and warranties
The Provider performs services with care and in accordance with professional standards. Its liability may only be incurred where fault is proven. Unless mandatory law provides otherwise, compensation is limited to direct and foreseeable loss, excluding in particular indirect loss or loss of revenue, except in cases of gross negligence or fraud.
The Client remains responsible for content, data and information it supplies and for compliance of its use with applicable laws (personal data, intellectual property, advertising, etc.).
Intellectual property
Unless otherwise agreed in the quote, the Provider’s pre-existing elements (methods, tools, templates, know-how) remain its property. Rights in deliverables specific to the engagement (source code, designs, content created for the Client) are defined in the quote (assignment, licence, reuse).
The Client warrants that it has the necessary rights in materials it provides (texts, images, trademarks, databases) and indemnifies the Provider against third-party claims based on those materials.
Personal data
Processing of personal data in commercial relationships and on yunt sites is described in the privacy policy. To exercise your rights (access, rectification, erasure, restriction, objection, portability where applicable), contact contact@yunt.fr.
Termination, breach and force majeure
In the event of a serious or repeated breach of contractual obligations, the other party may end the contract in accordance with the quote, these terms of sale and applicable law, after a formal notice that remains unanswered where required by law or contract.
Force majeure as defined under French law and case law suspends the obligations affected for its duration.
Disputes and governing law
These terms of sale are governed by French law. If no amicable settlement is reached, the courts with jurisdiction under French law have sole jurisdiction, subject to public policy rules and mandatory consumer provisions.
Where the Client is a consumer, remedies under the French Consumer Code remain available without prejudice to these provisions.
Changes to these terms of sale
The Provider may update these terms of sale. The version applicable is the one in force on the order date. Ongoing orders remain governed by the version accepted when the contract was concluded, unless the parties agree otherwise.
Consumer mediator
A consumer mediator has not yet been appointed. The name and contact details will be published here as soon as they are available, as required by the French Consumer Code.
Meanwhile, see the official list at economie.gouv.fr/mediation-conso and the European ODR platform.
